TERMS AND CONDITIONS OF BUSINESS

INTRODUCTION

1. This website is operated by Skinny Mat. Where these terms and conditions use terms such as “we”, “us” and “our” they refer to Skinny Mat.

2. We offer this website, including all the information, tools and services available on it, on the condition that you accept these terms and conditions and the associated privacy policy available on our website.

3. By visiting our website and/or purchasing something from us, you are deemed to have accepted these terms and conditions.

4. You can view the most current version of these terms and conditions at any time by visiting this website page. We reserve the right to update, change or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit, read these terms and conditions and ensure you understand them before making a purchase.

5. Nothing in these terms and conditions affects your statutory rights under the Consumer Rights Act 2015 or any other applicable legislation. Where any provision of these terms conflicts with your statutory rights, your statutory rights shall prevail.

GENERAL CONDITIONS

Colour Disclaimer

By placing an order with Skinny Mat, you acknowledge and accept that exact colour matching is not possible and is not offered as part of our service. All mats are produced using digital printing processes, which differ fundamentally from other colour reproduction methods including paint manufacturing, screen display rendering, and traditional printing. As a result:

a) Colours shown on screen are indicative only. Computer monitors, tablets, and phone screens all display colours differently. We print onto a white substrate, which means printed colours will typically appear lighter than what you see on screen. No adjustment, recalibration, or special request can overcome this inherent difference.

b) We do not and cannot colour match to paint, fabric, furnishings, or any other physical material. Where a paint colour or colour reference (such as a RAL, Pantone, Farrow & Ball, or other brand reference) is provided, we will use the closest available hex value as a starting point only. Due to the fundamental differences between digital printing and paint or dye manufacturing processes, the printed result will not be an exact match and may differ noticeably. This is not a defect.

c) Variation between orders is possible. Slight colour variation may occur between separate orders of the same design due to differences in print runs, material batches, and environmental conditions during production.

d) Refunds, returns, reprints, and replacements will not be issued for colour variations or differences arising from the factors described above, including but not limited to differences between: the mat and your screen display; the mat and a paint or material sample; the mat and a previous order; or the mat and your expectations based on a colour reference provided.

e) If you receive a mat that is obviously and fundamentally the wrong colour (for example, you ordered a blue mat and received a red one), please contact us with a photograph within 7 days of receiving your order and we will arrange a replacement. This does not extend to shade variations, lighter or darker tones of the correct colour, or differences between the printed colour and a paint or material reference. The determination of whether a mat is fundamentally the wrong colour is at our reasonable discretion.

By completing your purchase, you confirm that you have read, understood, and accepted this colour policy in full.

Made to Order

6. As all mats are made to order and none are held in stock, you have until the item goes to print production to cancel your order for a full refund. After they have been printed we do not offer refunds as all mats are made to order.

7. By purchasing from our website, you acknowledge and agree to our refund policy outlined on our refund policy page.

8. Your personalisation must be approved before going to print. If you receive anything other than what you have approved, please send us a photograph and we will happily send you a reprint of your approved design.

9. If you receive the incorrect size mat, please get in touch straight away with photographs of the mat against a tape measure and we will resend the correct size.

10. We do not offer refunds if the mat does not fit under the clearance of your door. It is your responsibility to ensure you have the 2mm clearance for the mat using a tape measure. If you are concerned due to a tight clearance please purchase a sample to check the mat fits before ordering.

Non-Slip Disclaimer

11. Our mats are designed to be non-slip on most surfaces. However, they may not remain securely in place on some flooring types, including but not limited to carpets, concrete, or polished floors, due to the nature of these surfaces.

12. As the mat has a non-slip backing, this is not a product fault. We do not offer refunds or returns if the mat slips on your flooring. It is your responsibility to order a sample to check compatibility with your flooring. We recommend using double-sided carpet tape or a non-slip rug underlay for added stability.

Fading Disclaimer

13. Our mats are not UV-resistant. Exposure to direct sunlight may cause colours to fade over time. This is a natural characteristic of many fabrics and materials when placed in bright or sunlit areas.

14. Fading due to UV exposure is not considered a fault, and we do not offer refunds, replacements, or exchanges for mats that have faded over time.

INTELLECTUAL PROPERTY & CUSTOMER CONTENT

15. You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit for commercial gain any portion of the content on this website or any other part of the service we offer.

16. Where you upload or submit any images, logos, text, or other content for personalisation of your order, you warrant that you own or hold the necessary rights, licences, or permissions to use that content and to authorise us to reproduce it on your behalf.

17. You agree to indemnify us against any claims, losses, damages, costs, or expenses (including legal fees) arising from any infringement of intellectual property rights or any other third-party rights in connection with content you have provided to us for personalisation.

18. We reserve the right to refuse to print any design that we reasonably believe may infringe the intellectual property rights of a third party, contain offensive or unlawful material, or otherwise expose us to liability.

ONLINE STORE TERMS

19. Our website offers a range of products and/or services for sale. Where we refer to an ‘item’ we are referring to a single product or service available for purchase on this website.

20. We will take all reasonable care to ensure that the details displayed for a particular item are correct at the time when the information was entered onto the system.

21. Whilst care is taken to display appearances, colours, textures, and finishes as accurately as possible, what you see on your monitor or device may differ. We cannot guarantee that images are an accurate representation of the actual goods you are purchasing.

22. We may not be able to accept your order due to one or more of the following reasons:

i) The item you have ordered is out of stock

ii) We cannot authorise your payment or have reasonable grounds to suspect fraud

iii) There has been a pricing or product description error

iv) There is a system or procurement failure

v) You have failed our customer validation checks

23. When you place an order you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

24. Your order will only be accepted by us once your goods have been dispatched.

MODIFICATIONS TO OUR SERVICE AND PRICING

25. Prices for items are subject to change without notice.

26. We reserve the right to modify or discontinue any part of the service we offer, or any content thereof, at any time and without notice.

27. We accept no liability to you or to any third party for any modification, price change, suspension, or discontinuation of the service.

DELIVERY

28. During checkout, you may be presented with one or more delivery options. Where an estimated timescale is provided, this is an estimate only and delivery may be delayed due to circumstances beyond our control (such as courier delays or busy periods).

29. Orders placed on Fridays, Saturdays, or Sundays may not be dispatched until the following Monday.

30. Risk of loss or damage to goods shall pass to you upon delivery to the address provided at checkout. If a delivery is lost or damaged in transit, please contact us within 7 days of the expected delivery date and we will investigate with the courier on your behalf.

ORDER CANCELLATION

31. If you wish to cancel an order, you must contact us immediately to ascertain whether the items have gone to production. Once items have gone to print production, cancellation is no longer possible.

32. Where items have not entered production prior to a cancellation request, our refund policy will apply.

33. All orders are made to order. Once they are in print production you will not be able to cancel for a full refund. Any time before going to print you will be eligible for a refund, so please get in touch as soon as possible.

LIABILITY AND INDEMNITY

34. We shall not be liable for any direct, special, indirect, consequential, or incidental damages including loss of profit or loss of opportunity as a result of the use of, or the inability to use, any items ordered on this website.

35. You agree to indemnify us and our agents, officers, directors, and employees, immediately and on demand, against all claims, liability, damages, costs, and expenses (including legal fees) arising out of any breach of these terms and conditions.

36. Nothing in these terms and conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

DATA AND PRIVACY

37. Any content that you enter onto this website may be transferred unencrypted and involve transmissions over various networks, and may involve changes to conform to the technical requirements of connecting networks or devices.

38. Any personal data you provide during the ordering and personalisation process (including names, images, and design files) will be retained only for the purposes of order fulfilment, customer service, and our legitimate business interests, in accordance with our published Privacy Policy.

FORCE MAJEURE

40. We shall not be responsible for any delay or failure to comply with our obligations under these terms and conditions where the delay or failure arises from circumstances beyond our reasonable control, including but not limited to: acts of God, fire, flood, or extreme weather; supplier or material shortages; equipment or machinery failure; postal or courier strikes or disruptions; pandemic, epidemic, or public health emergency; government actions or restrictions; and utility or telecommunications failures.

41. In such circumstances, we will not be liable for any loss that you incur, howsoever caused, and our obligations shall be suspended for the duration of the event.

JURISDICTION

42. These terms and conditions shall be governed by and construed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.

ENTIRE AGREEMENT

43. These terms and conditions, together with our published Privacy Policy and Refund Policy (both available on this website), constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us, whether written or oral.

GENERAL

44. Headings and titles used in these terms and conditions are for convenience only. They do not constitute any part of these terms and will not limit or otherwise affect the provisions herein.

45. Should any term or part-term be found to be unenforceable, the remainder of these terms and conditions shall continue in full force and effect as if the invalidated term were not present.
